LEGABIBO Applies to Join Marriage Equality Case Before the High Court

The Lesbians, Gays and Bisexuals of Botswana (LEGABIBO) has applied to join an important case currently before the High Court of Botswana concerning access to civil marriage for same-sex couples.

What Does It Mean to "Join" a Case?

Sometimes, a court case may have consequences that affect many people beyond those who originally brought the matter. In such situations, individuals or organizations whose members may be affected can ask the Court for permission to become part of the proceedings. This process is called joinder. LEGABIBO has asked the Court to allow it to join the case because the outcome could have a significant impact on lesbian, gay and bisexual people in Botswana, including same-sex couples who may wish to marry in the future.

Why Has LEGABIBO Made This Application?

For more than two decades, LEGABIBO has worked to promote equality, dignity and human rights for lesbian, gay and bisexual people in Botswana. As an organization representing members of the LGBTQIA+ community, LEGABIBO believes it is important that the experiences and concerns of those who may be affected by the Court's decision are properly placed before the Court. The organization's application is not about replacing the couple who brought the case. Rather, it seeks an opportunity to contribute to the proceedings and ensure that the voices of the broader community are heard.

About the Main Case

The main case concerns whether two consenting adults seeking to enter into a civil marriage may be denied that opportunity by the State. The matter raises important questions about equality, dignity and the treatment of all citizens under the Constitution.

Current Status

LEGABIBO's application was initially scheduled to be heard on 8 June 2026. The matter has since been postponed to 14 July 2026, when the High Court will hear LEGABIBO's reasons for seeking to join the proceedings. Following those arguments, the Court will decide whether LEGABIBO will be allowed to participate in the case.
